Brandon Barden’s DUI charge dismissed

    Charges stemming from Titans tight end Brandon Barden’s DUI arrest in February have been dismissed after the arresting officer failed appear in a Georgia courtroom.

    Barden, a former Vanderbilt player, was arrested for DUI after a single-car accident on Feb. 23 in Lincoln County, Georgia. He was cited for DUI and failure to maintain lane after refusing a field sobriety test, roadside Alco-Sensor testing and state chemical testing.

    Both citations were dismissed, however, because of a “lack of prosecution” in the case, a court official said on Thursday.

    “If the officer doesn’t show for court, everything is dismissed,’’ said Debbie Pruett of the Lincoln County probate office. “Brandon had an attorney and she requested it be dismissed for a lack of prosecution and the judge had no bearing to change it. It’s completely closed.”

    Attorney Michelle Harrison could not be reached for comment on Thursday and hasn’t returned calls since the incident. Barden’s agent, Joel Turner, also could not be reached for comment.

    Officer Christopher Treadwell wrote in his police report Barden lost control of 2008 GMC Sierra sometime before 4:30 a.m. on Feb. 23, and hit a ditch drain before the car flipped one and a half times, landing on its side.

    The police report stated Treadwell could “smell a strong odor of alcohol.” When Barden refused testing, he was charged with a DUI, according to police. Barden, who is from Lincolnton, Ga., had two passengers inside the vehicle, and he refused medical treatment at the scene, police said.

    Barden was charged with traffic violations that include DUI on refusal, and was booked into the jail.

    Judge Lee Moss dismissed the case when Treadwell failed to appear on the court date.

    “It is rare that they don’t (show up), but I think the officer had worked the night shift,’’ Pruett said.

    An undrafted free agent, Barden played in three games for the Titans last season, but did not have a catch. He was signed from the practice squad to the active roster on Dec. 13, 2012. Barden is working with the team in the offseason program and will compete for a roster spot this fall.

    Luckiest dude in Georgia today. He better be on the straight and narrow from now on. Maybe he should practice tea drinking, and hitting the sack at 9 PM.

    I wonder why the officer didn't show up.. maybe all it took was a nice phone call by the FO or something along those lines. You'd be surprised with what goes on behind the scenes like that.
