Suffering an injury isn't necessarily a requirement for criminal assault in some states. For example, in Texas bodily injury can be proven via showing that the victim suffered some form of physical pain even if there is no lasting injury.

If this does make it out of the NFLs hands then whatever, maybe it should.

I just dont think it will

Lawsuits from pretty much any injury on the field is a very bad idea for the league.

The penalties (specifically roughing the passer) are already ridiculous. Imagine if players now had to worry about getting sued over a hit.

Not saying that swinging the helmet is part of the game but in a way it is. The “weapons” are not only supplied to every player, they are mandatory.

Suspending him for the rest of the season and playoffs (not that they were going to the playoffs anyway) is a huge financial hit. Probably more punishment than a criminal charge would be anyway. Leave it on the field and let the NFL punish him.

Swinging a helmet is in no way a part of the game. Some of you are getting ridiculous.

Sorry, I've been flying back home and missed your post. @altitan would be better able to answer your question, I work for DOD.

That said, I agree that there's probably grounds for criminal assault charges if Rudolph chose to follow that route.

He absolutely could have been killed. Rudolph should get a hefty fine and a game, but Garrett could get an assault charge. In any other circumstance, he would.

    Absolutely true.

If that incident had been recorded in the private sector (outside of professional sports) there would be criminal charges filed.

I understand that Garrett was provoked, and support him retaliating up UNTIL the helmet swing.

Had he punched Rudolph in the face I'd be fully in his corner, but swinging a helmet is way over the top.

Pouncy is a punk. Hitting and kicking a man while he's held down is a punk move. I've a feeling that the players in the league have formed their own opinions on all of the players involved and will likely respond accordingly when they meet them on the field.

I don’t see Garrett getting charged although his actions certainly warrant it. His behavior was clearly outside the norm of the sport but because Rudolph wasn’t hurt I don’t think you’ll see anything. Does that make it right ? No. I agree like everyone else that Garrett knowingly and intentionally used a helmet to try and injure another player. If Rudolph had suffered a significant injury I think you would see criminal charges being brought up. Certainly Rudolph has a case to be heard if he does decide to go down that road. The NFL already came in and handed down their hefty discipline which I’m sure is playing a roll in some degree on whether charges should be pursued. It’s ugly no matter how you look at it and there’s no place for it.
