Stallworth Drunk During Accident

    First and formost, I want to applaud all designated drivers out there. There is just never enough of you guys. I volunteer from time to time. Esp @ titans games + 3 hour drive home.

    Bottom line, 30 days for killing a guy is BS. There was a gal up here that was drunk and killed a guy in an accident down the street from my house. A really pretty gal as well. She got 10 years. Donte Stallworth got 30 days. It just upsets me that people who are rich or famous get preferential treatment when they get in trouble.

    Donte Stallworth you lucky dog. I almost got 30 days for driving over 85mph sober. You lucky lucky mofo. Good for you, you really lucked out man. I hope hes' learned from this.

    For the most part I agree. In this case it's really hard to say without being there. I just don't know what role the victim played in the accident to come down too hard on Stallworth.

    30 days does seem light. But I don't think he should've done years at least with the amount of information currently available.

    What upsets a lot more than preferential treatment is the unevenness of sentencing.

    As a said a few posts up, a man beat another man to death in a bar and got 2 years.

    A girl you know got 10 years for a DUI murder.

    To me, the first is considerably worse than the second, yet the sentencing doesn't match that. Maybe she had prior offenses?

    Stallworth drove drunk - case closed. Even if the victim was wacked out on PCP he was not the one operating a vehicle.
    I see no defense for such a minuscule penalty. Congrats Florida.. you continue to get it wrong.

    That's pretty harsh. But it's pretty accurate as well I guess.

    Still, if someone steps out in front of his vehicle, there is nothing he could've done about it, whether inebriated or sober.


    Outside of the jailtime being so low, the other penalties seem pretty severe but fair considering.

    Florida DUI penalties for 1st time DUI:
    First Conviction: Not more than 6 months. With BAL of .20 or higher or minor in the vehicle: Not more than 9 months.

    And that's no fatalities.. This guy got off..

    I'm curious to see what the effect of the two year house arrest will be.

    Obviously, they went out of their way to reduce jail time to agree to other penalties. Ten years probation, two years of house arrest, never being allowed to have a driver's license again, and the fines (not to mention the private settlement with the family) are all nothing to laugh at. His life is going to be pretty restricted for quite a while.

    Yes, the tiny amount of jail time is a joke. He did take other penalties in exchange though.

    VERY curious to see what his suspension will be.

    I am not a lawyer but do have a familiarity with criminal law, and just because Stallworth plead guilty to DUI doesn't necessarily mean he was drunk. It may simply be to 'justify' A sentencing. The district attorney's office surly didn't want this to continue on for years, which it could. So they made something happen now by going easy on the jail time, and beefing up some house arrest time. Also notice Stallworth's sincerity in the whole thing. Appearing remorseful gets judges a lot.
