Titans are Suing USC

    Read Pola's contract and read the suit. Pay attention to the confidentialy portion of Pola's deal. This is a Titan/Pola problem....... proving Kiffen as an individual and USC did perform intentional tortious acts and omissions which caused injury to the Titans is going to be a b*%ch. I doubt it will ever see a courtroom.

    This is a PR move plain and simple by Uncle Bud and Underwood to sell tickets to us locals.

    AND.....to say that the court has "general personal jurisdiction over Kiffen because he has engaged in systematic and continuous activity within Tennesse" ......just because he lived in Knoxville for 13 months and bought a home there is ludacrious.

    What are the Titans thinking? Reading that whole thing, It looks like they are in collusion with the UT system trustees to besmirch him personally and USC is just collateral damage. Bad Juju on the Titans here.

    it's a tort. There's a state law against torting contracts and Kiffin torted. Thus this happens.

    Is anything much going to come out of this? No probably not.

    IS this just some big behind the scene to sell tickets to angry vols fans? No....I'm sorry but if you think that you're either blinded by your "the world hates SoCal" glasses or something else.

    If a contract with a business was breached in ways counter to what the contract said, there's often going to be some sort of lawsuit - there quite often is. And whenever there is a suit - really any kind of suit - it almost always reaches out for everyone/thing it can possibly hit in all directions; that's always how these work; it's always how a lawyer will present it.

    The Titans aren't trying to force Pola back or anything either; they know he's gone and don't want him back.

    I think the main possibilities coming from this are A) The Titans organization (as a business) wants monetary retribution for its contract (legal document) being broken in a way violating its stipulations

    or B) (possibly more likely if it's ruled in their favor, though it might not necessarily need to be) this is done in attempt to set precedent so that in the future coaches from NFL teams can't be "poached" (as it's been put) in hires and that everyone has to go through the proper discussion and contact channels that the NFL and its respective teams have set up to speak to coaches, assistant coaches, etc about potential hirings away from the organization.

    Yes, but they have claimed "intentional" tortious acts. Gonna be very hard to prove Kiffen and USC intentionally torted. This will never see a courtroom. If it does, the appeals will take a decade to sort out......In the meantime USC will be off probation and a top 5 team while the Titans will still be mediocre.

    What is treble Pola's salary with the Titans? Maybe $1.5M? Why didn't Underwood just ask the University for compensation? Now, we may see some libel and slander issues come into play from Kiffen, USC and Pola.

    Bad move from the Titans....especially the way this is playing out in the press.

    If you're so certain that the Titans will remain "mediocre", then why don't you jump your happy little azz over to a USC or Colts board and stop pretending to be a Titans fan here...?...:moon:

    Again my main points were all they're really wanting from this ideally is some financial action (make Kiffin or whoever pay, however you want to word it, with some financial penalty) and perhaps what they want more, to set precedent so that other NFL franchises wouldn't wind up dealing with any similar issues in the future.

    This also isn't a contract with a buyout clause. It's not like colleges paying the previous schools the buyout; it can't just work that way (and honestly, it's not like USC would just agree "here, take some money" without having to give said money)







    you know, if you're really just a USC fan and that's it, there are message boards for that.

    1. Everybody and their opinion should be welcome as long as the rules are followed. Our organization isn't perfect. Every fan has just as much right to be critical as supportive. The comments suggesting persons with dissenting opinions leave the board are close-minded and juvenile.

    2. The damage is done, Pola is gone, let's get over it.

    3. This lawsuit is a distraction and will continue to be as long as the Titans pursue it. IMO, we should be focusing our PR efforts on supporting/promoting the new RB coach and stop this charade of "setting precedent" to discourage others from engaging in similar behavior in the future. This lawsuite is a Fisher/Adams ego thing.

    4. Money is the only tangible outcome and the Titans can't even say yet how much we've been damaged. Also, you can't set a legal precedent for "courtesy calls". What if Kiffin had called, Fisher said no- you can't speak to Pola and then Kiffin did anyway? Does anybody really think an impartial court-room would agree that USC/Kiffin are legally prevented from making an offer anyway? Pola clearly violated his contract clause, USC/Kiffin aren't under contract with the Titans. The Titans chose to go after USC/Kiffin with a vague stretch because Fisher/Adams et al were slapped in the face by the "lack of courtesy". This lawsuit is ridiculous and it will be exposed and presented as such on a national level. There is nothing productive that will come of it for our organization. Drop it and let's focus on the upcoming season.
